Last week, it flexed that muscle.<\/p>\n<p>In response to what the Department of Labor organization <a href=\"https:\/\/www.constructiondive.com\/news\/osha-responds-to-alarming-increase-in-trench-deaths\/627365\/\" rel=\"nofollow noopener\" target=\"_blank\">called an \u201calarming\u201d increase<\/a> in trench and excavation deaths \u2014 22 thus far in 2022 compared to 15 in all of 2021 \u2014 OSHA said it \u201cwill consider every available tool at the agency&#8217;s disposal,\u201d including criminal referrals.<\/p>\n<p>But what does that mean for contractors?<\/p>\n<div class=\"figure_content\">\n<div><\/div>\n<\/div>\n<p>Trent Cotney<br \/>\nCourtesy of Adams and Reese LLP<\/p>\n<p>\u201cAlthough rare, owners can be prosecuted for these types of violations, especially if they knowingly disregarded safety protocols,\u201d said Trent Cotney, CEO of Cotney Attorneys &amp; Consultants and partner at Adams and Reese.\u00a0\u201cWith the increase in trench deaths caused primarily by the collapse of unstable material, it is not surprising that OSHA would underscore its capability to seek criminal penalties for violations.\u201d<\/p>\n<p>Cotney went on to say he didn\u2019t think the statement was a scare tactic, and that OSHA will find a case with suitable facts \u2014 essentially making an example out of a case as a deterrent and hopeful boon to trench safety efforts.<\/p>\n<div class=\"figure_content\">\n<div><\/div>\n<\/div>\n<p>Carol Sigmond<br \/>\nPermission granted by Courtesy of Greenspoon Marder<\/p>\n<p>\u201cOSHA might be looking to make an example of somebody,\u201d said Carol Sigmond, partner at New York-based law firm Greenspoon Marder.<\/p>\n<p>Major employer groups welcomed and even applauded OSHA for the announcement.<\/p>\n<p>\u201cIn light of the startling statistics that OSHA has presented regarding trench-related fatalities, ABC is encouraged that OSHA has announced enhanced initiatives to address trench safety,\u201d said Greg Sizemore, vice president of health, safety, environment and workforce development for Associated Builders and Contractors. \u201cClearly, trench safety needs additional focus and education. It is imperative that field team members work with safety professionals to ensure zero harm for all construction workers.\u201d<\/p>\n<p>Brian Turmail, vice president of public affairs and strategic initiatives for Associated General Contractors of America, said the organization was \u201cnot opposed\u201d to the initiative because OSHA already has a straightforward and effective standard for trench safety.<\/p>\n<p>\u201cWe want to make sure everyone in construction understands the requirements for safe trenching operations, and follows them, without exception,\u201d he said.<\/p>\n<p>Per OSHA, <a href=\"https:\/\/www.osha.gov\/trenching-excavation\" rel=\"nofollow noopener\" target=\"_blank\">contractors can prevent cave-ins<\/a> by sloping trench walls, shoring walls with support or shielding walls with trench boxes. Additionally, employers should ensure workers can safely enter and exit the trench, and keep an eye out for standing water or other hazards. Finally, workers should never enter a trench if it hasn\u2019t been properly inspected, OSHA says.<\/p>\n<p>Builders must remain vigilant, Sigmond said.
