{"id":10843,"date":"2022-08-30T14:49:00","date_gmt":"2022-08-30T21:49:00","guid":{"rendered":"https:\/\/essential.construction\/news\/?p=10843"},"modified":"2022-08-30T14:49:00","modified_gmt":"2022-08-30T21:49:00","slug":"court-partially-reinstates-federal-contractor-vaccine-mandate","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/court-partially-reinstates-federal-contractor-vaccine-mandate\/","title":{"rendered":"Court partially reinstates federal contractor vaccine mandate"},"content":{"rendered":"<div class=\"first-page-pdf\">\n<div class=\"article-title-wrapper\">\n<p>Construction and COVID-19<\/p>\n<\/div>\n<div class=\"byline\">\n<div class=\"article-byline\">\n<p>Published Aug. 30, 2022<\/p>\n<\/div>\n<\/div>\n<div class=\"figure_content article-hero-img\">\n<p>            U.S. President Joe Biden issued an executive order in September requiring federal contractors to be vaccinated for COVID-19.<\/p>\n<p>        Drew Angerer via Getty Images<\/p>\n<\/div><\/div>\n<div class=\"row\">\n<div class=\"article-large-12 columns article-wrapper\">\n<div class=\"print-wrapper\">\n<div class=\"large medium article-body\">\n<h3>Dive Brief:<\/h3>\n<p>The U.S. 11th Circuit Court of Appeals partially reinstated President Joe Biden\u2019s COVID-19 vaccine mandate for federal contractors, but still exempted seven states and members of Associated Builders and Contractors from having to the get the shot.<br \/>\n<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202114269.pdf\" rel=\"nofollow noopener\" target=\"_blank\">The ruling<\/a>\u00a0at least temporarily bars the vaccine mandate for ABC\u2019s members engaged in federal procurement contracts, as well as state agencies from the seven states party to the original suit: Georgia, Alabama, Idaho, Kansas, South Carolina, Utah and West Virginia.\u00a0<br \/>\nBut in other cases, the 11th Circuit said a Georgia federal district judge\u2019s ruling from December that blocked the mandate nationally was too broad. \u201cHere, the district court relied on improper considerations to justify its nationwide injunction,\u201d the 11th District\u2019s ruling said.<\/p>\n<p>Executive Order 14042, which Biden issued in September 2021, required parties contracting with the federal government to have their workers vaccinated against COVID-19. The order used the federal Procurement Act, which sets rules for government contracts, as its legal basis. <\/p>\n<p>Georgia, six other states and the ABC challenged the mandate, arguing that the Procurement Act didn\u2019t give the president the power to require vaccines. In December, Georgia Federal District Court Judge Stan Baker agreed, and <a href=\"https:\/\/www.constructiondive.com\/news\/white-house-sets-dec-1-coronavirus-vaccine-deadline-for-federal-contractors\/611169\/\" rel=\"nofollow noopener\" target=\"_blank\">issued an injunction on the order nationwide<\/a>. <\/p>\n<p>The federal government appealed, which resulted in Friday\u2019s ruling. It also prompted ABC to claim victory in the case.\u00a0<\/p>\n<p>\u201cThe court has made it clear that ABC members and state plaintiffs \u2018need not comply with the vaccination requirement in their capacity as contractors, and they are not responsible for including that requirement in lower-tier subcontracts,\u2019\u201d said Ben Brubeck, ABC\u2019s vice president of regulatory, labor and state affairs, <a href=\"http:\/\/link.mediaoutreach.meltwater.com\/ls\/click?upn=UWTPOntTWmS2iqF7rAbhXIlc9Fm03X7WyBs2gL2qzLZBplcEFi36UfZLGdGkCjf7sE1uoH-2BTwBrP4XZqEenltE0lk82imK6QgfLOYgNFOmGAtZuSihbc8emEHFej6zMB0nbFC5w9vK-2FTYRobCV-2BlPKj2nz9ITD4vgNELsEuYB9nnv7olNEw-2FDTc5jbMh7eZA_fHG_8aG8eKpzd-2BSP4khJa4sjP7TzvHIxs7FfLyxMKhhSnELIIGXMto8ezC3saOp9rjrSrFKFJvDAiOCudeCKdo3PD430NfMKn0fAo2dx8ieb-2BX-2FZXmT8EN89TeaDsimU-2BfpjCePcT-2FW7RFoprjIX2D2QcQIJlPTfpgzzgOcMcncafkjqZP7a1E5l3s4mhj5bnAnqr4zKNZy-2FlOcsdS3T74kjdZarZOB9HO2YmT1kgM3JKcavWU7jfs7maXqUfW5DjmZEkHnXL2ob0oRFtD7fznKpOiTf5if0ArqaLRYD45sQef6oTF7q85yZ0pOjlQy944UzM-2Br-2FPfq2HWqF3x1gFrfJi7z7SrTdZKUAeldYi2U4OXopKa8zJ9uth3iVt7-2FbT4poFcdJ3UoBthuhOsu9vOS9rA-3D-3D\" rel=\"nofollow noopener\" target=\"_blank\">in a statement<\/a>.<\/p>\n<p>The administration stopped enforcing the mandate after the Georgia ruling in December, and as of Monday, the Office of Management and Budget reportedly indicated that agencies shouldn\u2019t start doing so now, <a href=\"https:\/\/www.govexec.com\/management\/2022\/08\/ban-contractor-vaccine-mandate-was-lifted-partially-could-cause-confusion\/376458\/\" rel=\"nofollow noopener\" target=\"_blank\">according to Government Executive magazine.<\/a>\u00a0\u00a0<\/p>\n<p>According to <a href=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=4c4135bc-cd43-4b96-9348-1233992d2321\" rel=\"nofollow noopener\" target=\"_blank\">a post by attorneys from McGuireWoods<\/a>, as a result of <a href=\"https:\/\/www.mcguirewoods.com\/client-resources\/Alerts\/2021\/12\/federal-judge-temporarily-halts-enforcement-federal-contractor-vaccine-mandate-three-states\" rel=\"nofollow noopener\" target=\"_blank\">injunctions in other cases<\/a>, the executive order is also still enjoined in Alaska, Arizona, Arkansas, Florida, Indiana, Iowa, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Dakota, Tennessee and Wyoming.<\/p>\n<p>In total, that means the vaccine mandate is not enjoined in the remaining 25 states. Whatever the administration does from here, legal experts say that gives the White House some claim for a win in the case, too.<\/p>\n<p>Carol Sigmond, a partner in the construction and litigation practice groups at the Greenspoon Marder law firm, said she believed the administration would ultimately lose again if it challenged the 11th Circuit\u2019s ruling all the way to the Supreme Court. <\/p>\n<p>But she also saw plenty of reason for the administration not to take that action, or at least take its time doing so. <\/p>\n<p>\u201cJoe Biden&#8217;s in the middle of an epidemic, and he&#8217;s got to get as many shots in arms as he can, as fast as he can. He doesn&#8217;t care how he does it,\u201d Sigmond said of the reasoning behind the original executive order. \u201cSo he takes a risk, and he winds up with [half] the states.
