Birch Brothers (Kidderminster) Ltd to assist with the construction of a concrete overflow weir structure at Monks Pond, near Ashbourne in Derbyshire.<\/p>\n<p>The 48-year-old, from Alfreton, was with colleagues on a road above the work area waiting for the excavator to remove sand from trench boxes when it rotated clockwise and crushed him.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"163817\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=http%3A%2F%2Fwww.constructionenquirer.com%2Fdirectory%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><\/a><\/div>\n<\/div>\n<p>Kidderminster Magistrates Court heard that the Principal Contractor, Birch Brothers (Kidderminster) Ltd, had hired in steel fixers and joiners to undertake the work before tragedy struck on 5 September 2017.<\/p>\n<p>An HSE investigation found that the work had not been adequately planned, and no instruction had been given to the digger operator, or to pedestrians who were working in the area.<\/p>\n<p>The risks associated with the work had not been adequately assessed either, and there was no segregation of pedestrians and plant in this area of the site.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"466700\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.ukpowernetworksservices.co.uk%2Ficp-network-connections%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/01\/22022-UKPNS_Construction-Enquirer-MPU-V1.gif\" alt=\"-\"><\/a><\/div>\n<\/div>\n<p>The company had not appointed a banksman to ensure the safety of pedestrians while the vehicle was in operation and there was also nobody to oversee this element of the work to ensure it was carried out safely.<\/p>\n<p>Following the incident, a Prohibition Notice was served stopping further work involving mobile plant\/vehicles until the site had been organised in such a way in that pedestrians and vehicles could move without risks to safety.<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"438362\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.drsbonds.co.uk%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/01\/DRS-Construction-Enquirer-MPU-July-2020-st3C.gif\" alt=\"-\"><\/a><\/div>\n<\/div>\n<p>Birch Brothers (Kidderminster) Ltd of Stourport-on-Severn pleaded guilty to safety breaches and were fined \u00a3146,000\u00a0 and ordered to pay costs of \u00a34,621.90<\/p>\n<p>In September 2022 the company appointed liquidators.<\/p>\n<p>HSE Inspector Katherine Cotton said, \u201cThis was a tragic incident that was easily preventable.\u00a0 Those in control of work have a responsibility to organise their sites and devise safe methods of working, in relation to vehicles and pedestrians, and ensure they are implemented.<\/p>\n<p>\u201cConstruction site vehicle incidents can and should be prevented by the effective management of transport operations throughout the construction process.<\/p>\n<p>\u201cCompanies should be aware that HSE will not hesitate to take appropriate enforcement action against those that fall below the required standards.\u201d<\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"161795\"
