{"id":12001,"date":"2023-01-21T10:14:15","date_gmt":"2023-01-21T18:14:15","guid":{"rendered":"https:\/\/essential.construction\/news\/dhs-strengthens-deportation-protection-for-undocumented-workers-involved-in-employment-claims\/"},"modified":"2023-01-21T10:14:15","modified_gmt":"2023-01-21T18:14:15","slug":"dhs-strengthens-deportation-protection-for-undocumented-workers-involved-in-employment-claims","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/dhs-strengthens-deportation-protection-for-undocumented-workers-involved-in-employment-claims\/","title":{"rendered":"DHS strengthens deportation protection for undocumented workers involved in employment claims"},"content":{"rendered":"<p> <a href=\"https:\/\/essential.construction\/files\/membership-default-internal\/\" class=\"memberhide\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/01\/20220718_175041000_iOS.jpg\" alt=\"-\"><\/a><br\/><br \/>\n<\/p>\n<div>\n<p>Often earning low wages and experiencing discrimination, all while facing the ever-present threat of deportation, undocumented workers in the U.S. don\u2019t get many wins, said Luz Castro, deputy director of national policy for Coalition for Humane Immigrant Rights of Los Angeles.<\/p>\n<p>But the announcement by the U.S. Department of Homeland Security Jan. 13 of a new policy designed to offer labor protections to undocumented workers was \u201cdefinitely a win,\u201d said Castro. \u201cWith the announcement from DHS they really conveyed the message that they have a clear commitment to undocumented workers.\u201d<\/p>\n<p>The new policy grants \u201cnoncitizen workers who are victims of, or witnesses to, the violation of labor rights\u201d case-by-case protection from \u201cthreats of immigration-related retaliation from the exploitative employers,\u201d <a rel=\"nofollow noopener\" href=\"https:\/\/www.dhs.gov\/news\/2023\/01\/13\/dhs-announces-process-enhancements-supporting-labor-enforcement-investigations\" target=\"_blank\">DHS said<\/a>. Workers will be able to request deferred action, that is, deferral of deportation under prosecutorial discretion by first getting a letter of support from a local, state or federal labor agency, then submitting an application through a central intake point with the U.S. Citizenship and Immigration Services.\u00a0<\/p>\n<p>The new policy provides clear guidance, Castro said. \u201cWorkers have a better understanding of what the process will look like.\u201d<\/p>\n<p>Any undocumented worker is always taking a risk when submitting a form to an agency, Castro said, and she hopes the new guidance \u201cwill provide more confidence to workers.\u201d\u00a0<\/p>\n<p>\u201cUnscrupulous employers who prey on the vulnerability of noncitizen workers harm all workers and disadvantage businesses who play by the rules,\u201d Secretary of Homeland Security Alejandro N. Mayorkas said in a news release. \u201cWe will hold these predatory actors accountable by encouraging all workers to assert their rights, report violations they have suffered or observed, and cooperate in labor standards investigations.\u201d<\/p>\n<p>Raha Wala, vice president of strategic partnerships and advocacy for the National Immigration Law Center, called the policy \u201ca momentous victory\u201d that \u201cwill be critical to supporting collective organizing and making worksites across the country safer and more equitable for everyone.\u201d\u00a0<\/p>\n<p>AFL-CIO President Liz Shuler in a statement said the union supports DHS\u2019 efforts to enforce labor laws.<\/p>\n<p>\u201cWorkers rely on each other to take action to help enforce our labor laws, so we are all at risk when employers can use immigration threats to scare workers into silence.
