{"id":12769,"date":"2023-02-06T17:00:20","date_gmt":"2023-02-07T01:00:20","guid":{"rendered":"https:\/\/essential.construction\/news\/hcra-now-imposing-penalties-on-unethical-and-illegal-home-builders\/"},"modified":"2023-02-06T17:00:21","modified_gmt":"2023-02-07T01:00:21","slug":"hcra-now-imposing-penalties-on-unethical-and-illegal-home-builders","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/hcra-now-imposing-penalties-on-unethical-and-illegal-home-builders\/","title":{"rendered":"HCRA now imposing penalties on \u2018unethical and illegal\u2019 home builders"},"content":{"rendered":"<p> <a href=\"https:\/\/essential.construction\/files\/membership-default-internal\/\" class=\"memberhide\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/01\/20220718_175041000_iOS.jpg\" alt=\"-\"><\/a><br\/><br \/>\n<\/p>\n<div>\n<p>In what it describes as a move to protect home buyers, the Home Construction Regulatory Authority (HCRA) may now impose administrative penalties on Ontario home builders or vendors who breach their legal and ethical obligations.<\/p>\n<p>A new regulation now in effect adds administrative penalties \u2013 a financial penalty similar to a fine \u2013 to the HCRA\u2019s existing enforcement tools that include revoking or imposing conditions on a licence.<\/p>\n<p>\u201cThe HCRA is serious about holding new home builders and vendors accountable for their behaviour,\u201d Wendy Moir, HCRA\u2019s CEO and registrar, said in a news release. \u201cThese penalties are not just a cost of doing business. This is a clear message and reminder to the industry that unethical conduct and violations of the rules will not be tolerated.\u201d<\/p>\n<p>The recent legislative and regulatory changes to the New Home Construction Licensing Act, 2017 (NHCLA) include allowing the HCRA to use the proceeds of administrative penalties to provide funds to negatively impacted consumers, depending on the circumstances, HCRA said. The HCRA may consider whether a licensee benefitted financially from breaking the law and, if so, an additional penalty may be applied reflecting the amount of the benefit, which could be passed on to the impacted consumers.<\/p>\n<p>\u201cAdding financial penalties to the HCRA\u2019s regulatory toolbelt will enhance consumer protection and in some cases, provide funds to consumers who have been negatively impacted by a builder\u2019s or vendor\u2019s conduct,\u201d Moir said.<\/p>\n<p>Penalties can also be imposed on people or companies who operate without a licence \u2013 which is illegal.<\/p>\n<p>\u201cThese penalties \u2013 up to $50,000 per occurrence, depending on the contravention \u2013 are a first for the industry and will support an enhanced, fair and safe marketplace,\u201d Moir said. \u201cThey will support the HCRA in quickly taking action against illegal and unethical behaviour, both protecting consumers and ensuring a level playing field in the industry.\u201d<\/p>\n<p>To support an informed industry, the HCRA has issued several advisories to licensees, reminding them of their conduct expectations and the potential consequences for not following the rules.
