across 19 contracts worth \u00a3150m.<br \/><\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\">The long running investigation has culminated in <span class=\"m_2108222563922339070normaltextrun\">fines of \u00a359,334,957 for colluding on prices through illegal cartel agreements when submitting bids in competitive tenders for contracts. <\/span><\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"439734\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=http%3A%2F%2Fwww.intersteels.com%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><\/a><\/div>\n<\/div>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">These bids were rigged, deceiving the customer that they were competitive when that was not the case. <\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">Each of the ten firms was involved in at least one instance of bid rigging between January 2013 and June 2018. <\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">The fines for each are: <\/span><\/p>\n<ul>\n<li><span class=\"m_2108222563922339070normaltextrun\">Brown and Mason (\u00a32,400,000)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Cantillon (\u00a31,920,000)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Clifford Devlin (\u00a3423,615)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">DSM (\u00a31,400,000)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Erith (\u00a317,568,800)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">JF Hunt (\u00a35,600,000)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Keltbray (\u00a316,000,000)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">McGee (\u00a33,766,278)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Scudder (\u00a38,256,264)<\/span><\/li>\n<li><span class=\"m_2108222563922339070normaltextrun\">Squibb (\u00a32,000,000)<\/span><\/li>\n<\/ul>\n<p><span class=\"m_2108222563922339070normaltextrun\">Brown and Mason, Cantillon, Clifford Devlin, DSM, John F Hunt, Keltbray, McGee and Scudder were handed reduced fines as settling parties who had, as announced in June last year, admitted their involvement in the cartel activity.\u00a0<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"134243\" directors of companies involved in the unlawful conduct. <\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">These are David Darsey (formerly a director of Erith) for a period of 5 years and 10 months, Michael Cantillon (formerly a director of Cantillon) for 7 years and 6 months and Paul Cluskey (current director of Cantillon) for 4 years and 6 months. <\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">Each of these directors has benefited from reduced disqualification periods, having voluntarily agreed to the disqualification by way of undertakings to the CMA.<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"438362\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.drsbonds.co.uk%2F%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/01\/DRS-Construction-Enquirer-MPU-July-2020-st3C.gif\" alt=\"-\"><\/a><\/div>\n<\/div>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">The bids were rigged by one or more of the construction firms agreeing to submit bids that were deliberately priced to lose the tender. This practice of \u2018cover bidding\u2019 can result in customers paying higher prices or receiving lower quality services. <\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">In addition, the CMA found that five of the firms, on at least one occasion each, were involved in arrangements by which the designated \u2018losers\u2019 of the contracts were set to be compensated by the winner. Those firms were Brown and Mason, Cantillon, McGee, Scudder and Erith.\u00a0\u00a0<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">The value of this compensation varied but was higher than \u00a3500,000 in one instance.\u202f Some firms produced false invoices to hide this part of the illegal behaviour.<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">The CMA found that the instances of illegal collusion took place over a five-year period and affected 19 contracts for demolition work in London, the Southeast, and the Midlands.\u202f<\/span><\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"139541\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.mabeyhire.co.uk%2F%3Futm_source%3DConstruction%2BEnquirer%26utm_medium%3DDigital%2Bad%26utm_campaign%3DGo_Campaign%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/03\/1679585509_111_mabey Construction Enquirer MPU-300x250.gif\" alt=\"-\"><\/a><\/div>\n<\/div>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">The public and private sector contracts impacted included the development of Bow Street Magistrates Court and Police station, the Metropolitan Police training centre in Hendon, Selfridges (London), properties belonging to Oxford and Coventry Universities, shopping centres in Reading and Taplow, a large office block on London\u2019s Southbank and other sites in central London.<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">Not all the firms were involved in colluding in each of these contracts, and not every contractor who submitted a bid for these contracts was involved in the illegal collusion.<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">Michael Grenfell, the CMA\u2019s Executive Director for Enforcement, said:<\/span><span class=\"m_2108222563922339070eop\">\u00a0<u\/><u\/><\/span><span class=\"m_2108222563922339070normaltextrun\">\u201cThe construction sector is key to our country\u2019s prosperity, so we want to see a competitive marketplace delivering value, innovation, and quality.<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\">\u201cToday\u2019s significant fines show that the CMA continues to crack down on illegal cartel behaviour. It should serve as a clear warning: the CMA will not tolerate unlawful conduct which weakens competition and keeps prices up at the expense of businesses and taxpayers.<\/span><span class=\"m_2108222563922339070eop\">\u00a0<\/span><\/p>\n<div class=\"ad-mpu ad-mpu-inline\">\n<div class=\"sleeve\"><a rel=\"nofollow noopener\" data-ad-id=\"466921\" href=\"http:\/\/www.constructionenquirer.com\/wp-content\/themes\/constructionenquirer\/adclick.php?url=https%3A%2F%2Fwww.preconproducts.co.uk%2Fproducts%2Ffive-star%3Futm_source%3Dconstruction-enquirer%26utm_medium%3Dbanner%26utm_campaign%3Dconstructionenq-ads\" target=\"_blank\" onclick=\"track_ad_click(this);\"><img decoding=\"async\" src=\"https:\/\/essential.construction\/news\/wp-content\/uploads\/sites\/15\/2023\/03\/1679585509_177_five star concrete repair advert.gif\" alt=\"-\"><\/a><\/div>\n<\/div>\n<p class=\"m_2108222563922339070paragraph\"><span class=\"m_2108222563922339070normaltextrun\"><u\/>\u00a0<u\/><\/span><span class=\"m_2108222563922339070normaltextrun\">\u201cWe have also secured the disqualification of certain company directors involved.
