The new form will become available Aug. 1.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Additionally, the agency <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/public-inspection.federalregister.gov\/2023-15532.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>published a final rule<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> \u2014 effective the same day as the new form\u2019s release \u2014 amending its regulations to permit the secretary of homeland security to authorize \u201calternative document examination procedures\u201d as an alternative to in-person, physical review by employers.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>A separate document published by U.S. Immigration and Customs Enforcement Friday <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/public-inspection.federalregister.gov\/2023-15533.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>announced the authorization of one such alternative<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>. This alternative process, available only to E-Verify participant employers in good standing, permits employers to conduct remote documentation and verification via live video with employees once employees have transmitted their documents to the employer for review.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>This alternative process also will be available to eligible employers Aug. 1, ICE said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The updated Form I-9 includes a box the employer must check to indicate its use of an alternative procedure, according to USCIS.\u00a0\u00a0The new forms also remove the phrase \u201calien authorized to work\u201d \u2014 as used in the previous Form I-9 \u2014 and replace it with \u201cnoncitizen authorized to work.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The previous version of Form I-9 will also continue to be accepted through Oct. 31, 2023.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>USCIS\u2019s final rule creates a framework under which the agency could \u201cimplement permanent flexibilities under certain conditions, initiate pilot procedures with respect to the examination of documents, or respond to emergencies similar to the COVID-19 pandemic.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Friday\u2019s news is timely given that DHS\u2019 policy temporarily permitting remote verification, initially made during the early weeks of the COVID-19 pandemic, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.ice.gov\/news\/releases\/ice-announces-extension-i-9-compliance-flexibility-3\" target=\"_blank\"><span><span><span><span><span><span><span><span>is due to sunset July 31<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Attorneys who spoke to HR Dive said that employers generally have reacted positively to DHS\u2019 announcement. Scott Bettridge, chair of Cozen O\u2019Connor\u2019s immigration practice, said in an interview that the availability of a remote verification process through E-Verify is \u201cdefinitely welcome news,\u201d particularly for employers that have been gearing up for remote verification in some form.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cE-Verify is not perfect, but it\u2019s a good system that takes a burden off of employers,\u201d Bettridge added.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThe general sentiment in my interactions with most of my clients has been favorable,\u201d Jorge Lopez, shareholder at Littler Mendelson, said of the alternative process news in an interview. \u201cThey understand that there are nuances that they need to be concerned about, but I think there is a huge appetite in the business community to address the virtual review process and get away from this physical review process, which has been very onerous and problematic for companies.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>One such nuance is whether employers may use the alternative process to re-certify employees whose Form I-9 documentation had been examined remotely under the department\u2019s temporary remote verification flexibility. Employers may use the process to do so, providing they meet the following requirements:<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li><span><span><span><span><span><span>The employer was enrolled in E-Verify at the time that it performed the remote examination for verification or reverification of the employee\u2019s documentation.<\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<li><span><span><span><span><span><span>The employer created an E-Verify case for that employee.<\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<li><span><span><span><span><span><span>The employer performed the remote inspection between March 20, 2020 and July 31, 2023.<\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<p><span><span><span><span><span><span>The updated alternative process also requires employers to conduct a live video interaction, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.ice.gov\/news\/releases\/dhs-announces-flexibility-requirements-related-form-i-9-compliance#:~:text=however%2C%20employers%20must%20inspect%20the%20section%202%20documents%20remotely%20(e.g.%2C%20over%20video%20link%2C%20fax%20or%20email%2C%20etc.)%20and%20obtain%2C%20inspect%2C%20and%20retain%20copies%20of%20the%20documents%2C%20within%20three%20business%20days%20for%20purposes%20of%20completing%20section%202.\" target=\"_blank\"><span><span><span><span><span><span><span><span>which was not specified<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> under DHS\u2019 temporary verification flexibility.
