{"id":28750,"date":"2025-01-25T11:43:20","date_gmt":"2025-01-25T19:43:20","guid":{"rendered":"https:\/\/essential.construction\/news\/trump-orders-agencies-to-target-private-sector-dei\/"},"modified":"2025-01-25T11:43:20","modified_gmt":"2025-01-25T19:43:20","slug":"trump-orders-agencies-to-target-private-sector-dei","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/trump-orders-agencies-to-target-private-sector-dei\/","title":{"rendered":"Trump orders agencies to target private-sector DEI"},"content":{"rendered":"<p> [ad_1]<br \/>\n<\/p>\n<div>\n<h3>Dive Brief:<\/h3>\n<ul>\n<li><span><span><span><span><span><span>The White House <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-illegal-discrimination-and-restoring-merit-based-opportunity\/\" target=\"_blank\"><span><span><span><span><span><span><span>published an executive order<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> Tuesday that directs the heads of agencies, in cooperation with the attorney general, to submit a report by May 21 with recommendations to \u201cencourage the private sector to end illegal discrimination and preferences, including DEI.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<li><span><span><span><span><span><span>Per the order, the report should include key sectors of concern within each agency\u2019s jurisdiction; the \u201cmost egregious and discriminatory DEI practitioners in each sector of concern\u201d; steps or measures to deter DEI, including \u201cup to nine potential civil compliance investigations\u201d; potentially appropriate litigation approaches; and potential regulatory action or sub-regulatory guidance.<\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<li><span><span><span><span><span><span>The order also immediately revoked a number of Biden administration executive orders that apply to DEI in the government and among federal contractors and subcontractors. <\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n<h3>Dive Insight:<\/h3>\n<p><span><span><span><span><span><span>Trump\u2019s executive order \u2014 titled \u201cEnding illegal discrimination and restoring merit-based opportunity\u201d \u2014 expands his <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/trump-dei-executive-orders\/737810\/\" target=\"_blank\"><span><span><span><span><span><span><span>initial focus on federal diversity initiatives<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> to the private sector and more, signaling to the business community that DEI initiatives will be under close examination by the new administration.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Attorneys and courts have been carefully considering the legality of DEI programs for several years, as such programs exploded in both size and scope following the racial reckoning of 2020. Generally speaking, DEI has not been found to run afoul of civil rights law, the focus of Trump\u2019s executive order. One lawyer told HR Dive in 2022 that diversity initiatives that <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/can-dei-policies-clash-with-anti-discrimination-laws\/619538\/\" target=\"_blank\"><span><span><span><span><span><span><span>don\u2019t involve employment decisions<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, such as encouraging a wide range of applicants to apply, don\u2019t create much potential for legal action, for example.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>But other practices may be more questionable. In a December letter from the U.S. Department of Labor\u2019s Office of Federal Contract Compliance Programs to conservative advocacy group America First Legal Foundation regarding Southwest Airlines\u2019 DEI practices, the OFCCP acknowledged its regulations did not permit \u201c<\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/southwest-disputes-reports-its-dei-program-violated-the-law\/734843\/\" target=\"_blank\"><span><span><span><span><span><span><span>quotas, preferences, or set asides<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>,\u201d for example. The agency did not say it found the airline to be in violation of these policies.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Whether and how the Trump administration may widen the interpretation of legality with respect to DEI practices remains to be seen. America First Legal has taken an aggressive approach to corporate DEI in the past years \u2014 and its founder Stephen Miller is reportedly <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.politico.com\/newsletters\/west-wing-playbook\/2025\/01\/21\/its-stephen-millers-moment-00199774\" target=\"_blank\"><span><span><span><span><span><span><span>close to the administration<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> \u2014 perhaps forecasting an onslaught of investigative activity and legal action.
