A judge granted CWIT a <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.lawyerscommittee.org\/wp-content\/uploads\/2025\/03\/2025-03-27-Temporary-Restraining-Order-dckt-53_0.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>temporary restraining order on March 27<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> in its case against President Donald Trump\u2019s anti-DEI executive orders.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Initially, the nonprofit, which seeks to amplify the presence of tradeswomen in their industries, filed a lawsuit on Feb. 26 against Trump, the U.S. Department of Labor, then-Acting Secretary of Labor Vincent Micone, the Office of Budget Management, its Director Russell Vought, the U.S. Department of Justice and Attorney General Pam Bondi. The issue at hand was funding.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>According to CWIT, Trump failed to properly define DEI in his Jan. 20 and Jan. 21 executive orders, thus putting CWIT\u2019s funding \u2014 particularly for bolstering the presence of Black and Latina women in the trades \u2014 at risk.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThe anti-diversity EOs declare all diversity, equity, and inclusion programs illegal,\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span>and identify the lengths to which the federal government will go to end them,\u201d the <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.lawyerscommittee.org\/wp-content\/uploads\/2025\/02\/2025-02-26-001-Chicago-Women-in-Trades-Complaint.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>complaint<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> read. \u201cBut the anti-diversity EOs offer no explanation as to what types of programs to promote diversity, equity, and inclusion \u2018violate any applicable Federal anti-discrimination laws,\u2019 or how.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><strong><span><span>The temporary restraining order and its parameters<\/span><\/span><\/strong><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>The judge ruled that CWIT would be likely to succeed on \u201cthe merits of its First Amendment <\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span>claims involving the Termination Provision and the Certification Provision,\u201d and that CWIT demonstrated irreparable harm.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>In the original complaint, CWIT stated that the \u201cinability to provide education, training, support, and guidance for women in trades\u201d would be \u201cimmeasurable,\u201d and ultimately damage the trades industry and the national workforce as a whole.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThe balance of equities favors CWIT because of the severity of a First Amendment injury, because the government can still enforce the provisions of the Executive Orders that are unlikely to violate the First Amendment, and because the government can still enforce existing anti-discrimination laws,\u201d the judge said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>So as a part of the temporary restraining order granted, which is for now 28 days, the DOL is temporarily enjoined from canceling or pausing any of CWIT\u2019s grants. The government is also barred from Federal Claims Act enforcement against CWIT on this basis.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><strong><span><span>What happens next?<\/span><\/span><\/strong><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>\u201cNow, our focus turns to seeking a preliminary and eventually a permanent injunction to fully safeguard CWIT from being targeted for its work to promote diversity, equity, and inclusion for women in the skilled trades,\u201d Sabrina Talukder, senior counsel with the Lawyers\u2019 Committee for Civil Rights Under Law\u2019s Economic Justice Project, said in a <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.lawyerscommittee.org\/statement-from-lawyers-committee-senior-counsel-sabrina-talukder-on-temporary-restraining-order-in-anti-dei-executive-orders-case\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>statement<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Highlighting the need for nonprofits like CWIT to create a \u201clevel playing field,\u201d Talukder said that CWIT is \u201cstill at risk of being unjustly silenced and defunded.
