That contrasted with a still-on-the-books executive order from Biden\u2019s time in the White House, which mandated use of PLAs on projects receiving $35 million or more in federal funds.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Then, on April 9, NABTU and the Baltimore-D.C. Metro Building and Construction Trades Council filed suit in the U.S. District Court for the District of Columbia., claiming the exclusion \u201cinterferes with Plaintiffs\u2019 ongoing practice of negotiating such agreements with contractors bidding on federal large-scale construction projects.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>NABTU President Sean McGarvey praised the ruling.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cPLAs aren\u2019t political gimmicks or special-interest carveouts,\u201d McGarvey said in a statement. \u201cThey are proven workforce development tools that undergird strong economic growth in communities across the country.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Despite the injunction, the landscape around federal PLAs remains unclear.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>For one, U.S. Court of Federal Claims Judge Ryan Holte ruled in January in favor of employers on seven contracts that Biden-era <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/judge-rules-against-pla-mandate-biden\/738338\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>order would be anti-competitive<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> and relied on \u201carbitrary and capricious\u201d presidential policy. Nonetheless, the ruling applied to only those specific bid protests, which would mean any other contractors wishing to receive an exception to a federal contract requiring a PLA would need to file their own protest.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>On top of that, President Donald Trump has yet to remove Biden\u2019s executive order, despite signing one of his own guiding <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/trump-executive-order-plas-unions\/743292\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>rulemaking at agencies away from using PLAs<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> and other collective bargaining agreements.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Brian Turmail, vice president of public affairs and workforce for Associated General Contractors of America, said that the May 16 ruling demonstrates the need for the Trump administration to revoke what he called President Biden\u2019s &#8220;unlawful&#8221; executive order.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Kristen Swearingen, vice president of government affairs for Associated Builders and Contractors, also called for the revoking of the Biden-era order.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201c<\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.abc.org\/News-Media\/News-Releases\/abc-judge-favors-special-interests-on-federal-infrastructure-a-loss-for-taxpayers-and-the-nonunion-construction-industry\" target=\"_blank\"><span><span><span><span><span><span><span><span>ABC respectfully disagrees with the court\u2019s<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> reinstatement of illegal and costly project labor agreement mandates on a wide range of federal construction projects critical to America\u2019s national security,\u201d said Swearingen in the statement.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>She also said the executive order discriminates against non-union workers and discourages competition.
