Attorneys offer tips to navigate a \u2018thornier\u2019 year"},"content":{"rendered":"<p> [ad_1]<br \/>\n<\/p>\n<div>\n<p><span><span><span><span><span><span>With Pride month kicking off next week, HR professionals should consider several steps to advance belonging while mitigating legal risk, management-side law firms advised in recent days.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>June often brings workplace LGBTQ+ awareness activities, parade sponsorships and more, but this year may well look different because of executive orders aimed at curbing diversity, equity and inclusion programs.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Of particular concern for many employers is a January executive order calling for federal agencies to <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/trump-orders-agencies-to-target-private-sector-dei\/738044\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>target \u201cunlawful\u201d DEI programs<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Early guidance from one agency indicated that <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrlawwatch.com\/2025\/02\/11\/new-doj-directives-target-diversity-equity-and-inclusion-practices-under-attorney-general-pamela-bondi\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>cultural observances may not necessarily be a target<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, lawyers with Ballard Spahr noted earlier this year.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Still, some have urged caution until more guidance becomes available. \u201c[W]ith \u2018unlawful DEI\u2019 undefined in the EOs or otherwise, whether celebrations or education fall within that undefined term remains to be seen and will be highly fact-specific,\u201d Ogletree Deakins attorneys <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/ogletree.com\/insights-resources\/blog-posts\/from-pride-to-parity-legal-guardrails-for-managing-dei-events-and-celebrations\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>said in an analysis<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>That means cultural celebrations, acknowledgments and educational programs in the workplace \u201cpresent thornier issues today,\u201d they said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><span><span>Plan ahead<\/span><\/span><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>Preparation starts with asking the right questions, according to the Ogletree attorneys. They advised employers to consider whether federal funds might be used to pay for such activities, how the optics may affect employees, whether the organization celebrates other cultures and holidays, and the organization\u2019s risk tolerance, among other factors.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Employers should also plan to ensure all activities are voluntary and not exclusionary, they said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Communication also is key, according to attorneys for another firm, Seyfarth Shaw. The risk of employee anger \u2014 from several directions \u2014 is high, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/today.westlaw.com\/Document\/Ia0bf4bbe21f911f0875698c13ca0b72f\/View\/FullText.html?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true\" target=\"_blank\"><span><span><span><span><span><span><span><span>they said in an analysis<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>; and that anger can lead to calls for unionization or lawsuits alleging religious or gender discrimination.
