{"id":31409,"date":"2025-07-19T06:55:17","date_gmt":"2025-07-19T13:55:17","guid":{"rendered":"https:\/\/essential.construction\/news\/doe-to-drop-accessibility-requirement-for-buildings-receiving-federal-funds\/"},"modified":"2025-07-19T06:55:17","modified_gmt":"2025-07-19T13:55:17","slug":"doe-to-drop-accessibility-requirement-for-buildings-receiving-federal-funds","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/doe-to-drop-accessibility-requirement-for-buildings-receiving-federal-funds\/","title":{"rendered":"DOE to drop accessibility requirement for buildings receiving federal funds"},"content":{"rendered":"<p> [ad_1]<br \/>\n<\/p>\n<div>\n<p><span><span><span><span><span><span>New and existing buildings receiving funds from the U.S. Department of Energy won\u2019t have to meet accessibility requirements <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/14\/2025-13128\/rescinding-new-construction-requirements-related-to-nondiscrimination-in-federally-assisted-programs\" target=\"_blank\"><span><span><span><span><span><span><span><span>starting Sept. 12<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> in a fast-tracked <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2025\/05\/16\/2025-08535\/rescinding-new-construction-requirements-related-to-nondiscrimination-in-federally-assisted-programs\" target=\"_blank\"><span><span><span><span><span><span><span><span>rule rescission<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> that has alarmed disability-rights advocates.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The agency <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2025\/05\/16\/2025-08535\/rescinding-new-construction-requirements-related-to-nondiscrimination-in-federally-assisted-programs\" target=\"_blank\"><span><span><span><span><span><span><span><span>on May 16<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> used what\u2019s known as a direct final rule to announce it\u2019s rescinding a rule that\u2019s been on the books since the 1970s requiring any building receiving federal funds, whether for new construction or undergoing renovation, to be made accessible.\u00a0\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>DOE said the Section 504 rule, which was written by the then-Department of Health, Education and Welfare and incorporated by Congress into the <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hhs.gov\/sites\/default\/files\/ocr\/civilrights\/resources\/factsheets\/504.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>Rehabilitation Act of 1973<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, is unnecessary because of other federal requirements, so it is fast-tracking the rule rescission.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cGiven the general prohibition on discriminatory activities and related penalties \u2026 DOE finds these additional provisions unnecessary and unduly burdensome,\u201d the agency said in the preamble to the rule rescission. \u201cIt is DOE&#8217;s policy to give private entities flexibility to comply with the law in the manner they deem most efficient. One-size-fits-all rules are rarely the best option. Accordingly, DOE finds good reason to eliminate this regulatory provision.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The agency intended to make the rescission effective July 15 but pushed the date back to Sept. 12 after it received <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/14\/2025-13128\/rescinding-new-construction-requirements-related-to-nondiscrimination-in-federally-assisted-programs\" target=\"_blank\"><span><span><span><span><span><span><span><span>more than 20,000 comments<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, a significant number of which were protesting the action.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><span><span><span>Policy pushback<\/span><\/span><\/span><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>Disability-rights advocates say the agency is misusing the fast-track process. Direct final rules are intended for uncontroversial regulatory actions, like changing the name of a program, they say, not for rescinding a rule that\u2019s required under federal statute, as this one is.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThe Department of Energy\u2019s decision \u2026 is a direct attack on disability rights and part of a broader pattern of civil rights rollbacks aligned with Trump-era policies,\u201d Robyn Powell, an assistant professor at Stetson University College of Law, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.motherjones.com\/politics\/2025\/06\/energy-department-504-federal-disability-rights\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>told Mother Jones<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cI\u2019ve never seen [the process] before in my career, and most of my colleagues report the same,\u201d Claudia Center, legal director at the Disability Rights Education &amp; Defense Fund, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.disabilityscoop.com\/2025\/06\/09\/effort-to-roll-back-federal-disability-rights-protections-alarms-advocates\/31484\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>said in a Disability Scoop report<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>DREDF asked its supporters to send a letter to DOE protesting the rescission, saying the agency action goes against Congress and the courts.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cCongress passed the Rehabilitation Act,\u201d <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/dredf.org\/action-alert-doe-civil-rights-and-section-504\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>the suggested letter says<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>. \u201cCongress said it agreed with the 504 rules. Congress added the 504 rules to the Rehabilitation Act. The Supreme Court has looked at the rules and said they belong in the Rehabilitation Act. U.S. courts have spent years making sure people follow the rules.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Advocates say they\u2019re concerned other fast-tracked rescissions are to come.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThis action could be a \u2018trial balloon\u2019 for other agencies,\u201d Center said. \u201cThere are more than 80 sets of Section 504 regulations across the federal government. This could be the first of many.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Should the rescission take effect as planned, companies and other organizations that obtain DOE grants to make their buildings more efficient or for other purposes won\u2019t need to take steps to make the buildings accessible if they\u2019re not accessible already. Accessibility features can include ramps, wide doorways and railings.\u00a0\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The Section 504 rule gives building operators <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.ecfr.gov\/current\/title-10\/chapter-X\/part-1040\/subpart-D\/subject-group-ECFR32dfd35e0d6f9e2\/section-1040.73#p-1040.73(c)\" target=\"_blank\"><span><span><span><span><span><span><span><span>flexibility<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> in how they meet the accessibility requirements, which are based on the <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.access-board.gov\/aba\/ufas.html\" target=\"_blank\"><span><span><span><span><span><span><span><span>Uniform Federal Accessibility Standards<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a>,\u00a0<span><span><span><span><span><span>created in 1984. For example, there\u2019s no expectation for a building operator to make a structural change to a load-bearing wall to add an accessible feature.
