Please let us know if you have <a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/contact\/\" target=\"_blank\">feedback<\/a>.\n        <\/div>\n<\/p><\/div>\n<\/div>\n<p><span><span><span><span><span><span>ORLANDO, Fla. \u2014 From walkaround rules and proposed heat standards to a vacant review commission and a new president with new priorities, a lot has changed in the world of workplace regulations in recent months.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>A presentation this week during the American Society of Safety Professionals 2025 Conference + Expo sought to shed some light on these issues and more.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><span><span>Here are some of the important topics they touched on:<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><strong><span><span>Heat safety standard<\/span><\/span><\/strong><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>Last summer, under former President Joe Biden, <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/osha-heat-rule-impact-construction\/722383\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>OSHA proposed a standard<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> around heat injury and illness prevention. Employers decried the rule, saying it was overly burdensome and far too broad. Many lamented the acclimatization requirements and lack of geography-specific guidance.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>When President <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/trump-osha-heat-rule-impact\/732446\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>Donald Trump entered the White House<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> for a second time, it seemed the rule would likely vanish. That is, until a series of <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/osha-hearings-revised-heat-rule-construction\/751749\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>OSHA hearings this summer hinted<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> at a potential second life for a rule, albeit a drastically edited one.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cWhen Trump was elected I think I was among the first to say, \u2018I think we should move forward with some rule,\u2019\u201d said Heather MacDougall, corporate safety attorney and former vice president of safety for Amazon.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>MacDougall, who represented the U.S. Chamber of Commerce in hearings about the heat safety rule, and others have emphasized the value of a heat standard rule that is more performance-based \u2014 measuring employers\u2019 capacity to create and follow a plan to protect workers \u2014 rather than a detailed prescriptive plan that can be challenging to meet.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>To achieve such a plan, MacDougall said, it may be better to advance the rule under Trump or another business-friendly administration, rather than in a Democrat-held White House.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Jim Frederick, principal for Washington, D.C.-based consulting firm NexusHSE and former deputy assistant secretary of OSHA under Biden, worked at the agency at the time of the proposed rule\u2019s development. As a result, he couldn\u2019t speak to the contents of the rule at Tuesday\u2019s presentation.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Nonetheless, he lauded the number of businesses and employee groups responding to the rule with detailed input as \u201cphenomenal\u201d and underlined how far industries have come in recognizing the hazard.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>A decade ago, Frederick said, he heard a lot of \u201cwe\u2019re not, we can\u2019t, we won\u2019t\u201d in terms of creating a safer work environment in response to high temperatures.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cThe conversation has shifted dramatically around heat safety,\u201d he said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><strong><span><span>Walkaround rule<\/span><\/span><\/strong><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>Biden\u2019s OSHA also published and <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/osha-inspection-final-walkaround-rule\/712182\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>enacted the employee walkaround rule<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, which expanded the categories of people who could serve as worker representatives and accompany an OSHA inspector on a jobsite.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The goal of the rule was to clarify a long-held interpretation and clarify the \u201ccrux of the idea that the OSH Act gives employees the right to walk around during an inspection,\u201d Frederick said.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>But opponents of the rule say it raises <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.constructiondive.com\/news\/osha-walkaround-legal-questions\/724357\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>questions of liability and safety<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, and potentially opens the door to third-party representatives on the jobsite that would otherwise have no place there.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>MacDougall, however, took issue with the walkaround rule, disagreeing with OSHA\u2019s claim that it was a clarification. She believes the language goes far beyond that, and that the rule actually violates an employer\u2019s right to prevent third parties outside of the federal government from accessing a workplace.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The rule was promptly challenged in the U.S. District Court for the Western District of Texas, and both MacDougall and Frederick say they <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.uschamber.com\/cases\/labor-and-employment\/chamber-v-osha\" target=\"_blank\"><span><span><span><span><span><span><span><span>anticipate a ruling on its legality<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> soon.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h3 class=\"standard-heading\"><span><span><span><strong><span><span>Other changes<\/span><\/span><\/strong><\/span><\/span><\/span><\/h3>\n<p><span><span><span><span><span><span>All three seats are currently vacant at the <\/span><\/span><\/span><\/span><\/span><\/span>Occupational Safety and Health Review Commission, an independent agency that issues decisions when OSHA citations or penalties are contested<span><span><span><span><span><span>.
