OTTAWA \u2014 Ottawa-based asphalt paving company 769550 Ontario Ltd., operating as Ottawa Pavemaster,\u00a0is facing a significant fine after a worker was struck and killed at a jobsite in Kanata, Ont. in August 2023.<\/p>\n
On the day of the incident, Ottawa Pavemaster was completing a driveway paving job when a worker was walking along Desmond Avenue and was fatally injured by a reversing dump truck.<\/p>\n
The truck was driven by a company employee who was backing up approximately 200 feet to connect to a float, a trailer used to haul drivable equipment, explains an Ontario court bulletin.<\/p>\n
The driver was reversing the truck without the assistance of a signaller. This led to the worker being fatally struck.<\/p>\n
The company failed to ensure the driver of the truck was assisted by a signaller contrary to\u00a0Section 104(3) of Ontario Regulation 213\/91<\/a>, an offence under\u00a0Section 66(1)<\/a>\u00a0of the\u00a0Occupational Health and Safety Act.\u00a0Section 25(1)(c)<\/a>\u00a0of the act states that\u00a0\u201can employer shall ensure, that the measures and procedures prescribed are carried out in the workplace.\u201d<\/p>\n Following a guilty plea in Ottawa Provincial Offences Court on June 26, 2025, Ottawa Pavemaster was fined $115,000 by Justice of the Peace Harley Gervais.<\/p>\n<\/p><\/div>\n
