The U.S. Department of Labor said Thursday it <\/span><\/span><\/span><\/span><\/span><\/span>intends to revisit its overtime regulations<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> under the Fair Labor Standards Act but did not disclose a deadline by which to issue an update on the subject, according to a press release.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n DOL published its full <\/span><\/span><\/span><\/span><\/span><\/span>Spring 2025 regulatory agenda<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> via the White House Office of Management and Budget\u2019s regulatory affairs website after apparently removing <\/span><\/span><\/span><\/span><\/span><\/span>an earlier version of the list<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> published last month. The latest list retains efforts identified by DOL in August \u2014 such as proposed rules on the FLSA\u2019s joint-employer and worker classification standards \u2014 as well as a separate section on <\/span><\/span><\/span><\/span><\/span><\/span>long-term regulatory projects<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> including an overtime rule.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n Timelines on the different proposals vary. For example, DOL estimated that an updated <\/span><\/span><\/span><\/span><\/span><\/span>independent contractor rulemaking<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> could come by the end of September, while a proposed rule on <\/span><\/span><\/span><\/span><\/span><\/span>joint-employer regulations<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> was given a December 2025 estimate.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n \u201cThis regulatory agenda reflects our steadfast commitment to restoring economic opportunity by fostering innovation and reducing unnecessary burdens on employers,\u201d Deputy Secretary of Labor Keith Sonderling said in DOL\u2019s press release. \u201cBy modernizing outdated rules and prioritizing clarity and efficiency, we\u2019re building a more agile, worker-centered labor policy framework that fuels economic growth and prosperity.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n DOL said its <\/span><\/span><\/span><\/span><\/span><\/span>next action on overtime pay eligibility standards<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> is undetermined and similarly did not provide a firm date on when it would take action. The agency said it was reviewing the Biden administration\u2019s 2024 overtime rule, since <\/span><\/span><\/span><\/span><\/span><\/span>vacated by a federal judge<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a>, and \u201cdetermining how to proceed.\u201d The <\/span><\/span><\/span><\/span><\/span><\/span>Trump administration has already appealed<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> both of the two federal court decisions vacating the 2024 rule to the 5th U.S. Circuit Court of Appeals; the cases remain in litigation.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n A separate entry noted that DOL is also evaluating how to address aspects of the Biden administration\u2019s proposed overtime rule that it <\/span><\/span><\/span><\/span><\/span><\/span>did not finalize<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a>, namely updated standard salary levels for U.S. territories including Puerto Rico, Guam, the U.S. Virgin Islands, the Northern Mariana Islands and American Samoa as well as those for the motion picture industry.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n Other regulatory timelines clarified in DOL\u2019s update include a May 2026 target date for rulemaking on <\/span><\/span><\/span><\/span><\/span><\/span>investment advice fiduciary rules<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a> under the Employee Retirement Income Security Act.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<\/p><\/div>\n
