{"id":34467,"date":"2026-02-28T01:31:12","date_gmt":"2026-02-28T09:31:12","guid":{"rendered":"https:\/\/essential.construction\/news\/nlrb-reverts-to-joint-employer-rule-it-crafted-in-trumps-first-term\/"},"modified":"2026-02-28T01:31:12","modified_gmt":"2026-02-28T09:31:12","slug":"nlrb-reverts-to-joint-employer-rule-it-crafted-in-trumps-first-term","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/nlrb-reverts-to-joint-employer-rule-it-crafted-in-trumps-first-term\/","title":{"rendered":"NLRB reverts to joint employer rule it crafted in Trump\u2019s first term"},"content":{"rendered":"<p> [ad_1]<br \/>\n<\/p>\n<div>\n<p><span><span><span><span><span><span>The National Labor Relations Board announced a final rule Thursday to <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/s3.documentcloud.org\/documents\/27419907\/2026-03955.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>withdraw its Biden-era joint employer rule<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> in favor of a standard it adopted in 2020 during the first Trump administration.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>A <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/texas-judge-vacates-joint-employer-rule\/709820\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>federal judge previously vacated<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> the now-withdrawn rule \u2014 which was published in 2023 \u2014 because it was both \u201ccontrary to law\u201d and \u201carbitrary and capricious,\u201d following a challenge filed by business groups. NLRB said the 2023 rule has never taken effect and that <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/breaking-nlrb-finalizes-joint-employer-rule\/572918\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>the 2020 rule<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> was and remains the operative rule for determining joint employer status under the National Labor Relations Act.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>NLRB also said it determined that good cause existed for issuing Thursday\u2019s rule without prior notice and opportunity for public comment. The withdrawal of the 2023 rule is effective immediately.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cOur action is ministerial and therefore will have no separate economic effect,\u201d the board wrote.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Joint employer status has had a long, back-and-forth history between recent presidential administrations. The two major parties have offered divergent perspectives on what the NLRA requires in order to find that two or more employers are joint employers of the same employee.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The 2023 rule, for instance, stated that such entities are joint employers if they share or codetermine essential terms and conditions of employment. This occurs, per the rule, when the entities possess or exercise either direct or indirect control over one or more such terms.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>NLRB first applied that standard in its <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/s3.documentcloud.org\/documents\/23887881\/nlrb-2015-browning-ferris-industries-decision.pdf\" target=\"_blank\"><span><span><span><span><span><span><span><span>2015 <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><em><span><span><span>Browning-Ferris Industries<\/span><\/span><\/span><\/em><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span><span> decision<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span>, which was itself subject to an attempted reversal during the first Trump administration.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>The board\u2019s 2020 rule was meant to overturn the rationale behind <\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><em><span>Browning-Ferris<\/span><\/em><\/span><\/span><\/span><\/span><span><span><span><span><span><span>. It limited joint employer status under the NLRA only to those entities that possess and exercise substantial direct and immediate control over an employee\u2019s essential terms of employment. The 2020 rule also exclusively limited the list of essential terms to factors such as wages, benefits, hours of work, hiring, discharge, discipline, supervision and direction.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Thursday\u2019s rule retains the 2020 rule\u2019s language, defining \u201csubstantial\u201d direct and immediate control to mean that which has a regular or continuous effect on an essential employment term or condition, rather than on a \u201csporadic, isolated or de minimis basis.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Unlike the 2023 rule, the 2020 rule specifies that indirect control is probative of joint employer status, but only to the extent that it supplements and reinforces evidence of possession or exercise of direct and immediate control.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>\u201cJoint-employer status must be determined on the totality of the relevant facts in each particular employment setting,\u201d NLRB said. \u201cThe party asserting that an entity is a joint employer has the burden of proof.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>Sen. Patty Murray, D-Wash., criticized the decision in an email to HR Dive, writing that the 2020 rule gives \u201cthe biggest corporations cover to deny workers their ability to band together for better wages and working conditions and leaving millions of workers in the lurch, vulnerable to egregious violations of their rights.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span>In a twist earlier this week, NLRB said it would <\/span><\/span><\/span><\/span><\/span><\/span><a rel=\"nofollow noopener\" href=\"https:\/\/www.hrdive.com\/news\/nlrb-browning-ferris-decision-dc-circuit\/812993\/\" target=\"_blank\"><span><span><span><span><span><span><span><span>reaffirm its 2015 <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><span><span><span><span><em><span><span><span>Browning-Ferris<\/span><\/span><\/span><\/em><\/span><\/span><\/span><\/span><span><span><span><span><span><span><span><span> decision<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/a><span><span><span><span><span><span> that the titular employer, Browning-Ferris Industries, was a joint employer under the standard outlined by the Obama-era board.
