{"id":8718,"date":"2022-03-22T22:43:37","date_gmt":"2022-03-23T05:43:37","guid":{"rendered":"https:\/\/essential.construction\/news\/worker-fired-from-meta-project-for-leaving-a-noose-on-site\/"},"modified":"2022-03-22T22:43:37","modified_gmt":"2022-03-23T05:43:37","slug":"worker-fired-from-meta-project-for-leaving-a-noose-on-site","status":"publish","type":"post","link":"https:\/\/essential.construction\/news\/worker-fired-from-meta-project-for-leaving-a-noose-on-site\/","title":{"rendered":"Worker fired from Meta project for leaving a noose on site"},"content":{"rendered":"<p><em>Editor&#8217;s note: This story includes language that could be disturbing to readers.<\/em><\/p>\n<h3>Dive Brief:<\/h3>\n<p>M.A. Mortenson fired a worker who admitted tying a hanging noose on the construction site for Meta&#8217;s $1 billion Eagle Mountain, Utah,\u00a0data center, shutting down work for the third time since November for potentially hate-related crimes.<br \/>\nWorkers at the site found a yellow rope with about six coils wrapped around the loop in an open area of the 2.4 million-square-foot facility (above), according to Sgt. Spencer Cannon of the Utah County Sheriff&#8217;s Office.<br \/>\nMortenson, the general contractor for the project, stopped work at the site Monday, and doubled to $100,000 a reward for information identifying the perpetrator. The worker, whose name was not released, admitted to leaving the noose on the ground.\u00a0<\/p>\n<p>The discovery of the noose followed other hate incidents at the project. The site, which employs about 1,500 people, <a href=\"https:\/\/www.constructiondive.com\/news\/mortenson-shuts-down-meta-facebook-jobsite-hateful-graffiti\/609782\/\" rel=\"nofollow noopener\" target=\"_blank\">was shut down<\/a> for three days last fall when hateful graffiti was found in a port-a-potty declaring &#8220;Kill a n&#8212;&#8211;\u00a0day 11\/29.&#8221; Other hate speech was later found elsewhere on site.\u00a0<\/p>\n<p>While the male employee violated Mortenson\u2019s policies against harassment and discrimination, the company was still considering what legal steps it would take.\u00a0<\/p>\n<p>&#8220;This individual voluntarily came forward and is remorseful for what occurred,&#8221; said Cameron Snyder, corporate public relations lead at Mortenson, in a statement. &#8220;In accordance with our policies, the individual&#8217;s employment was terminated.&#8221;<\/p>\n<p>Following the earlier incidents, Mortenson installed cameras to monitor the restrooms, as well as a sign-in sheet, according to Cannon, the public information officer for the sheriff&#8217;s office.\u00a0If prosecuted, he said the incident would likely be classified as a misdemeanor, punishable by six months to a year in jail.\u00a0\u00a0<\/p>\n<p>Cannon said an individual tying a noose in today&#8217;s social climate, particularly on a site where hate-related shutdowns had occurred before, and not knowing its implications, strained credibility.\u00a0<\/p>\n<p>&#8220;I&#8217;m not sure I believe it,&#8221; Cannon said. But he added that proving intent would likely be part of the investigative process and make it more challenging to press charges. &#8220;I&#8217;m sure that the noose was tied intentionally, but what the actual intention was, without the individual telling us, it would be hard to prove otherwise.&#8221;<\/p>\n<p><a href=\"https:\/\/www.justice.gov\/hatecrimes\/laws-and-policies\" rel=\"nofollow noopener\" target=\"_blank\">Federal hate crime laws<\/a> can be applied to the display of nooses, and several states, including Oregon, Louisiana, Virginia, California, New York, Maryland and Connecticut have similar laws.\u00a0<\/p>\n<p>While Utah does not, the Department of Justice classifies the state&#8217;s hate crime laws as among the most broadly applicable in the country.\u00a0Utah&#8217;s hate crime code targets actions taken against persons for reasons related to race, color, national origin, religion, sexual orientation, gender, gender identity or disability, according to the DOJ.\u00a0<\/p>\n<p>At the other end of the spectrum are South Carolina and Wyoming, which don&#8217;t include such characteristics in their laws.<\/p>\n<p>Since George Floyd&#8217;s murder in May 2020,<a href=\"https:\/\/www.constructiondive.com\/news\/special-report-how-racism-impacts-construction\/587397\/\" rel=\"nofollow noopener\" target=\"_blank\">dozens of racist incidents<\/a> have emerged on major commercial construction jobsites, including the hanging of nooses and hateful graffiti.\u00a0Turner Construction<a href=\"https:\/\/www.constructiondive.com\/news\/a-timeline-of-racist-incidents-on-us-and-canadian-construction-sites\/586766\/\" rel=\"nofollow noopener\" target=\"_blank\">shut down other Meta jobsites<\/a> in 2020 in Ohio and Iowa, when similarly racist epithets, as well as a noose, were found.\u00a0<\/p>\n<p>In 2021, multiple nooses appeared on the <a href=\"https:\/\/www.constructiondive.com\/news\/rc-andersen-takes-steps-to-address-nooses-on-amazon-jobsite\/601046\/\" rel=\"nofollow noopener\" target=\"_blank\">jobsite of an Amazon fulfillment center<\/a> in Connecticut, prompting general contractor RC Andersen to install cameras throughout the facility.\u00a0<\/p>\n<p>Nooses <a href=\"https:\/\/www.constructiondive.com\/news\/nooses-found-at-merck-princeton-u-construction-sites\/601874\/\" rel=\"nofollow noopener\" target=\"_blank\">were also found<\/a> at Merck&#8217;s $105.4 million, federally funded renovation site near Durham, North Carolina, where it retrofitted a plant to manufacture Johnson &amp; Johnson&#8217;s single-dose COVID-19 vaccine in 2021.<\/p>\n<p>But <a href=\"https:\/\/www.constructiondive.com\/news\/ellisdon-ups-reward-in-jobsite-noose-cases-to-50k-vows-to-expel-perpetrat\/587678\/\" rel=\"nofollow noopener\" target=\"_blank\">rarely<\/a> have any suspects been identified in these types of cases.<\/p>\n<p>Both Mortenson and Turner were founding members of the inaugural<a href=\"https:\/\/www.constructiondive.com\/news\/construction-inclusion-week-why-6-top-ceos-are-drawing-a-line-on-hate\/607634\/\" rel=\"nofollow noopener\" target=\"_blank\">Construction Inclusion Week<\/a> in 2021, which was launched in an effort to combat these types of incidents in the industry, while welcoming more diverse workers to the trades.<\/p>\n<p>&#8220;We strongly condemn and have zero tolerance for hate, racism or bigotry in any form, and we have a clear anti-harassment, anti-discrimination policy,&#8221; Mortenson&#8217;s Snyder said in the statement about the latest incident. &#8220;Mortenson is committed to creating and upholding a culture of inclusion, fostering a diverse workforce, and to maintaining an environment where safety, dignity, and respect for everyone on our project is paramount.&#8221;\u202f\u00a0<\/p>\n<p class=\"itemsource\">This item was originally posted here: <a href=\"https:\/\/www.constructiondive.com\/news\/worker-fired-from-meta-project-for-leaving-a-noose-on-site\/620850\/\" target=\"_blank\" class=\"feedzy-rss-link-icon\" rel=\"noopener nofollow\">Read More<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>Editor&#8217;s note: This story includes language that could be disturbing to readers.
