All employers in Quebec will be required to take several steps to prevent and address workplace sexual violence according to a bulletin issued by APCHQ. Regulation concerning measures to prevent or stop a situation of sexual violence clarifies and reinforces the obligations of employers regarding the prevention and management of situations of sexual violence in the workplace. It clarifies the powers of Bill 42 to prevent and combat psychological harassment and sexual violence in the workplace. The regulation comes into force May 27, 2027.
Among the measures to be put in place, employers will have to:
- Inform workers in writing of the risks identified or analyzed, the interactions that may lead to sexual violence, the prevention measures and the procedure to be followed to make a complaint;
- Offer mandatory training to all workers, renewed every three years, covering in particular:
- the definition of sexual violence;
- behaviors to be avoided;
- the effects of sexual violence on individuals;
- the rights and obligations of workers and the employer;
- Establish a complaint and reporting procedure including the designation of a qualified person to receive and handle complaints with diligence and impartiality;
- Provide support for any worker who makes a complaint or makes a report.
